I was referring to his ex-girlfriend's ability to say anything she wants because she's the "victim" and how many men are innocent?
She can SAY anything ... the state can ACT on that which it is legally permitted or legally mandated to act upon.
There is no objective means by which to evaluate how many accused batterers are factually innocent.
Is this not a professional"s opinion site? I can tell from the comments I received that my post only received comments from non-professionals.
You can tell that, huh?
No one here is a seer. No one here witnessed the events in question. The law is more about process than it is about the truth, and the sooner you understand that, the better.
You say that he lost his job and his finances are in arrears as a result of the accusations. Well, HOW did she cause this to happen?
If you think the simple questions you got here were rude or tough, just wait until he gets into a courtroom! Hoo-Boy!!
My post was in regards to the women/men who abuse the system (I am only referring to the ones that are NOT true victims and I realize there are many real victims).
Too often people waste tax payers money by getting mad at an EX or a family member- call DHS, or file a false report on someone because they want to cause a lot of trouble for them.
So, you didn't have a question, you were venting. I am sure you can find plenty of web sites created for that purpose where you can find like minds where men will lament being falsely accused and slap each other on the back as they complain about the system. But, this site is not intended for that purpose.
Can someone who makes a false report get in trouble? Absolutely! How often does it happen? Not very. Absent convincing proof that a victim made a knowing and false report to the police, the state is simply not going to act on the allegation. However, the allegation must still be proven beyond a reasonable doubt in court before someone can be convicted, so the process does hold the state accountable to prove the case at hand in some way.
Is this not a site that can offer suggestions for innocent people?
Yep. And attorneys are often the best remedy because the attorney will have access to your brother's statements, the police reports, the evidence, and all the other information he might need to make an informed decision of the strength of the case against him, and maybe a possible cause of civil action against her if there is sufficient proof to show that she made the whole thing up.
I think everyone should to be subject to a lie detector test!
I don't. They are highly subjective and there exists no national standard on the use or interpretation of the devices. Plus, there are people who can beat the machines, and there are tricks that can be used to try and beat them. Someone who is a sociopath will likely beat the machine every time.
No one is perfect, but I happened to hear the whole fight.
Unfortunately for your brother, you did not SEE it.
No one here is saying he was not the victim of a vindictive ex. The problem is, the system does not have an easy safety valve to allow him recourse simply because he cries foul. The system is designed so that it might prevent a miscarriage of justice and generally requires the state to prove its case in court. That's most often how a weak story or unbelievable victim can be beaten challenged.
Until the days of Minority Report (the Tom Cruise movie) come to pass for real, we have to rely on the tried and true method of justice.
