We are very worried about my fiance's ex wife(she's remarried now)who has entered our residence without our consent, continues hanging onto to him, calls him saying she's worried if he's ok cause she hasn't heard from him, sent him a dvd saying things like I'lll never let you go, I'll always love you....as a friend, I tried to find a way to have 2 husbands, then she relents saying she hears in his email,which asks her to respect boundries,he needs to live his life then dramatically throws the email in the recycle bin stating he should do the same. She has sabotaged the computer and repeatedly takes things & returns them without notice or request. These items were part of community property but she uses it as a revolving door excuse and also as her reason for getting into my personal belongings. She's gone thru a range of excuses from I need to see if any of my things are in your closet, I need to see my dogs, I need food from the garden, and finally she came over finding the locks changed, left a voicemail saying her divorce decree says she has right to check on workability and liveabilty of her house and she's going to break in and her ex will be paying for repairs cause he can't stop her from entering the home she co owns with him and he'll come home and find a **** load of crap!
The decree states they do co-own the home and he is to live in it, do everything to it, sell it, split the proceeds with her. She says now she will not sign off unless she gets to be here and make sure things are the way she wants them. Now I also live here with my property and pets. They have no children but have dogs which are not included in the divorce decree. The decree states only the co ownership and his sole responsibility for everything and her getting half the proceeds.
The police stopped her break in last weekend and served the TRO at his residence since she's changed her address and won't give the new one to him.
They separated in Apr 08, divorced finalized Sept 08. She took almost everything of value from the house from Apr 08 to Mar 09, bringing her boyfriend over to help her. She's taken money from the mortgage account, took and hid the remaining home improvement money before he even thought about it, and changed her name and address on this acct and many others such that her ex husband, my fiance', cannot get history or statements on many things. The bank won't release records because her name is on them yet my fiance's paycheck goes in the acct. The do-it-yourself divorce she prepared gives them co ownership in the home but he has sole responsibility and burden to pay mortgage, taxes etc, live in home, sell it by a deadline and give her half the proceeds.
We are worried about a confrontation outside the courthouse, worried about our pets and property, and certain she's getting an attorney to secure as much money and property as possible.
Under what circumstances would a court NOT be likely to grant longer length restraining order after having granted a temporary order?
What criteria does the court use to decide?
In the upcoming hearing wherein the court will consider granting a longer restraining order, can the respondant have an attorney with her while we don't?What is the name of your state (only U.S. law)? |
