I live in Florida. My husband is verbally, mentally, and has been physically abusive. He also has a police record. I have a very good job and am a very upstanding citizen. However, I suffer from depression and take medication. My husband says that if I try to divorce him he will try to prove me "unfit" and try to take the kids away. I have only seen a psychiatrist for "medication management" - no psychotherapy. I am very stable and love my children very much. They are being hurt psychologically by all the tension and verbal abuse in the house. I have had two restraining orders on him in the past for abuse. What are my chances in court as to the "unfit" thing?

Limited.. but the main worry is why you are still with this man despite his past. You and your children are suffering and yet you still stay.. how many Restraining Orders are you going to get before you actually stand up for yourself and leave this bum ?

Why is he still in the house when there is a RO ? Did you cancel it ? Get another one now and have the police serve it on him, he will be escorted out of the house with only the cloths on his back. Then go see an attorney.
