Admitting Illegal Drug Abuse

First Post w00t!

Earlier today I was accused of rape, I have a lot of connections within the community and as a result the detective has given me until 10:00am, Monday morning to get my affairs in order.

Here is my question:

Up until I almost overdosed last week I was taking large amounts, 4-5 doses at a time of Hydromorphone and Darvocet; at those doses I would not be able to achieve an erection let alone maintain one.

My question is if I admitted this drug abuse to the detective, what legal ramifications would I be looking forward to?

I have a prescription for the Darvocet. I do not however have a prescription for the Hydromorphone and I also flushed the remainder of them down the toilet last week.

I am an English professor and I have taken the bus to work since I placed on narcotics last year after having my kidney removed.

You are facing serious charges. You need a lawyer. He can take the information, protected by attorney-client privilege and compare that to the other evidence against you to see if it would be exonerating. An erection isn't necessary for rape. However, it may be inconsistent with the victim's testimony.

My lawyer is a deacon of my church and I would prefer to keep him or atleast my drug abuse out of this matter for as long as possible.

The detective was nice enough to relate the accuser's statement to me and she pretty much gave a story book forced sexual encounter.

hiding facts from your lawyer won't help you stay out of prison. Get another lawyer whom you can talk to frankly.

Or, better yet, have a discussion with your current lawyer and discuss your defense and your weaknesses with drugs and your plan for adressing the issue. Churches are full of both sinners and forgiveness.

Did you really rape the girl? You are going to need a really good lawyer, not a free advice forum.

No I did not "really" rape the girl and do not think viagra would mix well with my dialysis treatment.

For an English professor, your grammar is atrocious.
Thank you for taking note of my lack grammar. I would like to point out that the English language is the product of two sets of ideologies; the fixed and the non-fixed. At no point should an informal conversation ever be hindered by the archaic preachings of Samuel Johnson of Henry Fowler. And I would like to assume everyone here is an adult and as adults are capable of deciding when it is appropriate to limit themselves to a Johnsonian form of writing and when it is not.


I went to the hospital this morning to have a toxicology test preformed afterwards I stopped by my place of work to borrow one of the pharmacology professors who is familiar with my physical condition.

At the police station my colleague explained my toxicology screen and my condition. The charges were dropped, the accuser was arrested for filing a false report and I made a small donation to the policemen's local so that my illegal abuse of a S2 Controlled Substance went unnoticed in the paper work.

I would like to thank everyone who provided valuable information and support.

Had you actually been charged, the police could not and would not have been able to drop them. The authority for that decision lies with the state.

I find it interesting you never deny the charges in the post. I also find it likely you have not seen the end of this situation.

I take it you have never lived in a small town?
It doesn't matter the size of the town because in Texas criminal charges can only be filed by a District or County Attorney. It is State law. It seems like what happened is that the detective closed out the case without referring charges to the DA for prosecution. Ozark_Sophist was talking about an actual criminal case being filed, not just a criminal investigation being opened.

Within two days of posting his question and not getting the answer he wanted, he took a friend with him to the police station who said "Hey, I just gave this guy a toxicology test in my office and proved he's innocent" at which point the police said "Gosh, we're sorry, we'll just drop the whole thing" and also before the day was out they arrested the alleged victim?

Bull****.
