I walked into the court house to obtain a copy of my birth certificate and ending up being arrested for drug parapheralia. I had a pipe, that is sold in most tobacco stores and such places. The metal detector was what got it. I was told that I was going to be arrested, his exact words the was escorted into the magistrates office where i was given a bond of 300 dollars and waled back to be searched and placed in jail. I was not read my miranda rights, therefore not being asked if I understood them. I also had someone with me and they were left standing there untill the officer that arrested me came and told her what was going on and that if I had not had an out of state drive license I would have had the pipe confiscated and been let go with out further problems. I guess my question is where do I stand as to what my rights were and if I was in the wrong. Every one automatically assumed I was on crack. when this pipe had never in the 3 years I had it been smoked out of. Also everyone said they it smelled as though it had been recenty smoked out of. What can I do and where do I go from here? Thanks for any help. This is also in north carolina, if that helps any.
