Caught buying drugs, receive summons?MA - I know someone who was recently caught buying drugs. After the deal occurred, the dealer drove away and two undercover cops pulled up on his car. One cop ran up, showed his badge, and saw the person holding two pills of ecstasy (which the dealer had unusually thrown in for free.) The person admitted to buying the ecstasy. The cop assured him he was not getting arrested, he would just receive a summons to appear in court which the cop said he would not pursue, and took down all his information (including name, address, mother/father's name, place of work, license plate). The person did not have his drivers id. He then told the person to get out of the car and thoroughly searched the car (without asking for permission) and found a small amount of cocaine and marijuana (both under a gram). The person admitted to also buying this from the same dealer. The cops then left and let the person drive away. What could happen to him? When he receives his summons, should he have a lawyer with him when he goes to court? |

| Thank you for your help. Just a few more questions - what do you think might happen to him? What do you think the cop meant when he said he would not pursue it? Will the summons be served in the mail or by someone in person (at work?) |

| Your friend is guilty of at least two felonies and one misdemeanor. No one on this board can tell the future so the punishment may range from probation to jail time. |

| Once the charges are brought by the state the officer is no longer involved. |

| This is my understanding. The person who got caught buying the drugs told on the person he bought them from to avoid prosecution. So, your friend made a deal with the police. Regardless, the police can still arrest your friend in the future. Also, the evidence against the dealer is your friends statement so the dealer will soon learn he has been betrayed. Stay away from the whole situation, sounds like things are getting ugly. You certainly cannot trust your friend as it sounds like he would tell on his own mother to avoid paying the consequences for his own actions. Some people are extremely weak and afraid. That is not the kind of people you need to be surrounding yourself with. |

| Listen, no on here knows what happened that evening, they probably didn't need him to rat, because they just caught the whole thing on camera, and with the evidence they had, they were just not going to deal with more paperwork for your friend. They had the guy they wanted, and your friend was just in the way. But we don't know and we cannot speculate. The summons may come in the mail. I doubt they are going to come hunt your "friend" down to serve him. but again, nobody knows. Your friend really does need to go this over with a lawyer, and if he cannot afford one, he can request one when he appears for the summons. Never trust the police, they are to protect and serve (their jobs) lol. J.K by the way, but seriously, tell your friend to speak to a lawyer, after he receives the summons... and if he never receives anything, then he should count his blessings and cut the garbage, clean up, and live straight... next time he might not be so lucky.
