charged w disribution of lortabs


What is the name of your state (only U.S. law)? NY
my apt was raided yesterday and they DEA found multiple prescription bottles but no actual pills in them, no pills at all were found AT ALL, do they have a case of distribution of lortabs if they didnt find any??

It would be hard for them to make a case based solely on empty bottles. The thing you have to consider is how did they get the warrant? They may already have you on tape or recording making a sale and executed the warrant to further cement their case. You will need the discovery package before you can be certain of the states case. The residue in the bottles may be enough for a possession charge. If they already feel they have enough evidence they may have not even sent the bottles to the lab. Again, you will have to see what they have,usually for distribution they have a c.i. or a detective made a buy.goodluck.

Yep, this is serious. You need a lawyer. If they have other evidence the empty bottles may be further nails in the coffin, so to speak.
