conspiracy charge etc, what do u think of their case


What is the name of your state? PA

I was giving a ride to an african american male in homewood, pa which is predominantly african american population and it was about 3AM. I had pulled over to pick him up and while awaiting his arrival, I noticed a Police car drive by. It was late at night and so I assumed he noticed me, a white male, waiting in a parked car as he then proceeded to drive around the block a few more times and realized he was watching me. After waiting a few minutes, the African american male entered my vehicle and brought along a female african american and she got in the backseat. I was parked right by a stop sign which was at a T meaning i HAD to turn left or right. I may have forgetten to signal that i was turning left but i clearly stopped at the stop sign and their was no traffic at this late hour and proceeded to make a left turn. After I made that left turn, the SAME cop that was watching me immediately pulled me over and said that he pulled me over because i did not use my turn signal. ( I looked up 75 Pa C.S. 3334A which states that u need to use your signal when turning from one lane to another or use reasonable safety. I used reasonable safety as it was late a tnight with no traffic and it was a T at that stop sing. I had to turn left or right and even though no one was behind me, if there even was, they would know i would HAVE to turn and that constitutes it being a safe turn that i made) I am saying this because i feel i shoul dhave never been stopped and none of my occupants searched. The officer targeted me racially in that neighborhood which is unconstitutional and did not wonder why i didnt use my signal or have me checked out to see if i was drunk. Instead, his first question after telling me why i was pulled over, was "open your mouth ". He didnt ask me or my passengers if he could search us but he demanded it. That is unconstitutional. After he saw that nothing was in my mouth, he demaded to see the insides of my african american passengers mouth. He then saw something in his mouth and forcibly removed it from his mouth outside of my car. It was 3 pieces of cocaine. Then without asking me again, he searched my entire car and found in the center console a BRAND NEW UNOPENED glass rose (which they ASSUME is crack pipe) and also found one little BRAND NEW bundle of chore boy. Also, after i was arrigned i found out that the officer charged me with windshield obstruction and wipers from having a small air freshner hanging on my rear view mirror. It is so small and doe snot block any of my view. Its one of those small paper ones and he did it out of spite. The officer was EXTREMELY unporofesional and was calling me a retard and other vulgar names when i was defening my constitutional rights and the fact that i should have never been pulled over. Just to note,I have NO criminal record whatsoever which should give me some credability to my statements about my opinion of clearly seeing what the officer was up to which was to watch me and then conduct this illegal search and seizure and even pulling me over.

In summary i was charged with 4 violations, 1 count each

windshield obstruction and wipers -- for a small air freshner hanging on the rear view mirror. This is the only charge i would possilby plead guilty to but i doubt that he took that air freshner into evidence. If he didnt, then there is no evidence .

improper turn without a signal- as stated before, i very safely made a left hand turn after comming to a complete stop. I was actually parked by that stop sign and this was a completly dead part of thhe night with no traffic whatsoever and the statue says making a turn after being parked can be done so without a signal with reasonable safety.

possesion of drug paraphenlia- There was a BRAND NEW glass rose and BRAND NEW chore boy in my car in the center console. Now here is what i woudl like to know. Many stores on penn avenue in east liberty sell these items such as Exxon on 40th and penn avenue. To find me guilty on this, the court would be saying that it is illegal for me to go into Exxon and purhase these itmes and as soon as i walk out the store, i am commiting a crime. If so then fine but it should be illegal for them to sell it but they are allowed to sell them as novelty items. These were stil in BRAND NEW condition in my car and are considered NOVELTY ITEMS, well the glass is, and the chore boy is for washing tough dirty dishes. if the paraphenlia was used by drugs or in a used condition then their case would very strong for this charge but it is not.

criminal conspiracy- this is the weakest of all charges. I did not conspire with the african american male to buy drugs. They took him out of the car and found drugs on him. I was only giving him a ride. this needs no more explanation but i know they need more than heresay and other evidence to prove it

well, any adivce / opinions on this before i go get a public defender and give him this that i wrote

My advice would be to fully utilize the prison library and higher education opportunities after excepting the best plea bargain you can get.

OP, where you on cops? This sounds just like an episode I saw not too long ago.
Hire a lawyer and take a plea. Everybody at one time has " No criminal record whatsoever", it really doesn't help your credibility. Wheather or not the evidence collaborates your story is what gives you credibility. When someone is parked in a known drug area at 3am, it is going to arouse police suspicion.
