can you be charged with a sale of a drug ,if all you did was take the drug from one persons hand to another persons hand , and same goes with the money received for the drugs?

Yep. I am not going to go read the entire statute, but if you were part of the transaction that passed drugs off to someone you were involved in dealing drugs. You do not get a pass because you are the middle man.

Sale does not require an actual "sale" where money is exchanged. If you pass the drugs to another person that is considered "criminal sale of a controlled substance".

I usually refrain from simply saying the same thing as the other posters, but in this situation I do not see how it could be considered anything else .There are always exceptions, and as some people say, "anythings possible", but realistically intent or sale sounds like it fits right in. goodluck.

Even if you are generously giving drugs away for free, it's still distribution as far as the law is concerned.
