my brother in law was arrested in october, in sonoma county, california, for drug possesion of meth and parafinilla. he has 2 priors. he has been clean for 4 years and had a small relapse. the possesion was the remanants on a small baggie. (this is considered 3cents worth). he was originally stopped because he "looked" like someone who just beat up someone. he cops searched him and found a pipe. then they took him down to the hospital and the guy that got beat up said that my brother in law was not the guy. the cops then searched him again and again and found the baggie. he has had 2 priors and an attemted possesion. does prop 36 apply to him? can he get out of this somehow? it was an awful mistake.
