Drug Tests of Inmates Already in Prison

My friend is incarcerated in a Kentucky State Prison (he is still in the classification procedures). He just arrived there Dec. 26, 2001 for non-payment of child support & escape charges. He turned himself in on Nov. 30, 2001. On Jan. 4, 2002 they (the prison) performed a random drug test that came back positive for a very low level of marijuana. He frequently used marijuana on the street before Nov. 30, 2001. The prison has him going before their court on Thurs. Jan. 17, 2002 for charges of drug use while in the prison or they may decide that it was positive because of the usage before turning himself in. Is there a statue or law where they can not charge him with the drug offense that never happened while in PRISON only on the street.
