From the state of Illinois. An aquintance pled guilty in state court and recieved probation. Now nine months later he was taken to jail for federal conspiricy to distribute charges. All charges stem from the same arrest nine months ago. Can the feds do this after the state has already past judgement on cocaine crimes?

My response:

Yes. The State has their shot at him under State Law. Now, the Feds get their chance under Federal law. Two different jurisdictions, and different charges - - even though stemming from the same criminal act or acts.

You don't think State laws and Federal laws can be violated in the same crime? Think again.

Remember the cops who beat up Rodney King in Los Angeles? They were tried (and sadly, acquitted on assault, battery, attempted murder, etc.) in Simi Valley, California (a State Court), and then were tried on different violations (Civil Rights) in Federal court.
