What is the name of your state (only U.S. law)? new york, but the incident in question occured in ohio.

hello all, here's the situation: you are from new york. you were arrested for a felony 5 possession of methadone(60mg) in ohio, then your case was dismissed in the municipal court. you were in jail for 10 days, released upon your case dismissal. several months later, you receive a continuance in the mail and learn that your case, although dismissed in municipal court, has been picked up by the higher court, the court of common pleas, and you were indicted. you have to fly out for the arraignment and any other legal proceedings. this is your first offense in any state. you went to a 28-day rehab facility in new york several days after being released from jail, completed it, and then entered an intensive outpatient program that you attend five days a week and that drug tests randomly. all of your results have been negative, you went to the rehab and therapy program of your own volition, and you can provide documentation attesting to these facts.

questions:
-in the event that you plead not-guilty and receive a plea deal, what would it likely be dropped to?
-what would be the punitive consequences for whatever it is dropped to?
-if put on probation, as is likely, would they set it up in ny or would you transfer or what?
-possibility of further time in jail?

thank you.

Any felony is a serious charge that probably carries the possibility of significant prison time.

You're insane if you haven't retained a good Ohio lawyer yet. Beg / borrow / pray, do whatever, but come up with the money for a good lawyer (like you did for rehab). It could mean the difference between jail and freedom.
