What is the name of your state (only U.S. law)? Pennsylvania
My 18 yr old daughter was pulled over for driving 41 in a 30 mile construction speed limit. The officer asked if he could search the car because he said it smelt like marijuana, Upon searching the car he found an unopened bottle of alcohol under some items on the back seat floor. An expired drivers license in the console of somebody we don't know but he said it looked like my daughter and it stated the driver was 22. He searched her purse and found less than 30 grams of marijuana in the purse, he did a field sobriety test and she passed. The vehicle is our spare car that anybody uses when they need it. She has 3 other siblings who are over 21. Do we need a lawyer.

It would be smart for your daughter to have a lawyer, yes.

If charged with possession of marijuana, first offense, your daughter could be offered diversion to keep a conviction off her criminal record. Here is a link to the law: http://norml.org/laws/item/pennsylvania-penalties-2.

Again, your daughter should speak with an attorney in her area if/when charged with one or more of these offenses. The attorney can work with the prosecutor to get her the best possible outcome based on the facts.
