how long can a motion for new trial sit in the courts

What is the name of your state?What is the name of your state? florida
my brother has a public defender and has a motion for new trial that has been there since june third of this year, with nothing else done. how long can it hang and should we be looking for new counsel?

I would suspect that his time for appeal and new trial have long since passed.

Yes, time for a new lawyer (although it is doubtful that, since your brother let all this time pass, that a new lawyer can do anything).
