How long do Police have to file charges?What is the name of your state (only U.S. law)? PA Son pulled over; friend had and admitted on the spot small amount of marajuana was his; cops threw it on ground and crushed into the street; no charges have been filed yet (2 months since incident); son & friend told to walk home / car confiscated; company atty said police illegally confiscated car citing 3 MD statues; Chief of Police "upset" I stated this to get car back now says he has 1-year to file charges and will now be doing so; basically in retailiation for my accusations of his department. Is 1-year correct? What charges? |

| 1 year is correct. Considering the police no longer have any evidence, proving a case is going to be difficult at best.
