MIP sober not drivingWhat is the name of your state (only U.S. law)? Massachusetts I am 18. I was picked up by some friends and there was unopened beer in the back seat. We were pulled over because the car fit the description of a car involved in some minor property damage (under $250) which I was not involved in but the other two drivers were. When the officer approached the car he saw the beer and all 3 of us were arrested for Minor in Possession of alcohol and the other 2 were charged with destruction of property. I have no prior charges and no criminal record. No one in the car had been drinking and none of us were issued a beathalizer test. Can I qualify for a diversion program? If so what does that entail. If I don't qualify, what consequences will I suffer. |

| You were charged with possession, not consumption. Breathylizer testing is not required.

| Well what am I looking at here, a fine, community service, will my license be suspended? What about that diversion thing |

| I would guess that they will make you tell them who sold you the beer and arrest them. You will probably have to some community service like picking up trash off the side of the road. And pay fines because courts love to fine people. So maybe you should get some extra shifts down at the ol' job and save up some cash. |
