NCIC background checks for pharmDAlabama When I was in my Sophomore year of my undergraduate, my fraternity was busted for possession of a controlled substance, most of us were arrested. I was never indicted for the charge but am a little worried whether it will show up on an NCIC report (or any background check). I am currently in my second year of a four year Doctor of Pharmacy program. I am worried that with my arrest from 4 1/2 years ago I may have trouble getting a position. I only have two more years for the program and I am in need of any sound advice. Will I have problems even though I was never indicted because it was a drug related arrest? Thank you |

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |

| They actually gave me the typical political answer by saying that unless you are convicted the arrest will not count against you. I understand "by law" that it won't count against me, but when it comes to choosing between two interns, I feel that might be a deciding factor. And I have already spoken to a lawyer about an expungment, but she informed me I shouldn't have any problems as long as there are no further arrests and the case was dropped without an indictment. She explained it may be something that will come up when getting hired but not preventing me from getting certified. |

that"s strange, I was once arrested but never indicted and the arrest never made it to the internet county files. |

Thus, if your arrest got into one of those databases, it will never get expunged. |

| I appreciate the advice, I will continue to ask a couple of pharmacists and speak with the Alabama board of Pharmacy. If you have any other sound advice or information I would greatly appreciate it. I am going for a research position anyway, perhaps they will look at it differently if I am not working directly with narcotics, etc. I have been told of several cases where M.D.'s, D.O.'s, O.D.'s and PharmD's have all had prior drug or alcohol related offenses and still practiced. Normally if the offense is found, they are questioned and reviewed but internships and grades play factors too. Thanks again |

I thought that if their was no county record of it then maybe it wouldn't show up on a background check. From what seniorjudge says it really depends on what databases are available to the company doing the background check. |

| this thread is about pharmaD background checks and they will not go through a company anyway ... the school could but the state boards will not they will take fingerprints and send them to the state and FBI which will report all on record convictions on you.. in my state (i am wanting to be a pharmacist) misdomeaner convictions such as drugs and violence is grounds for dismissal of application .. drug charges requires DEA waviers in order to practice. It is also important to note that as long as all your requirements of the court has been satisfied then you can apply for expungement and they should not be able to use midomeaner expungments against you .. However, in my state the state background check reports expungments for cetain crimes that are grounds for denial in the application process, They get a genertic report that states "disqualifing record found" or "no disqualifing record exists for this person" so be truthful cause they can and do issue waviers |
