need help....FAST!!!


What is the name of your state (only U.S. law)? tx
my husband has been falsely accused of possession of a controlled substance more than 4g less than 200g...by the cops on statement the substance was found in the immediate area....he was stopped for any reason he was simply visiting a friend and the cop(dressed civillian and in his own vehicle) asked him to come downstairs to talk with him....the cop also stated that my husband evaded arrest but he is not charged or initially charged for that matter....he was on probation and the motion just came through to revoke...he still hasnt been indicted and he was charged on the 27th after sitting in city jail for 71 hours...what can we do??? is there anyway to speed up the process so we can get past all this...i have heard from people that this officer is a crooked cop but he is also a highly decorated officer so i now it will be hard to try and discredit him....

It looks like your husband is going to need a criminal defense attorney. Nothing we can do to help speed up the process. In fact we won't be much help at all.

There is not much (if anything) you can do to speed up the process. The police are completely aware of his probation status, and once violated he can be h.w.o.b. which gives the police all the time they need. This cop may be decorated, but if you decide to go to trial, the 1st thing your attorney would do is file a motion to suppress.If the motion is filed in regards to a false statement than the officers internal file can be presented. So if he is crooked like you say than maybe there have been several complaints filed which would cast doubt on his testimony. When was the motion to revoke implemented? Before or after the arrest? What was the reason for the search? All valid questions that should be answered ti give us a better idea of the situation.goodluck.

What dave meant was you need to hire a criminal attorney. Good luck discrediting a highly decorated officer that your drug addict friends claim is crooked. May I venture to guess that your husband was on probation for a previous possession of a controlled substance conviction?
