Plea offered is too much


What is the name of your state (only U.S. law)? GA

I was set up by a CI and it's my 1st offense ever for sale of 2 lortabs. I was offered first offender act, but got 3 months in jail and 10 years probation. As well as a $2,000 fine and community service. Isn't this alot for my first offense? How can I convince the District Attorney to lower my plea?

You can have your attorney beg, plead, cajole, or whimper. The bottom line is that the DA does not HAVE to do anything. Maybe he'll offer something better, maybe he won't.

I know you dont want to go to jail...but from my perspective it doesn't seem like a lot for trying to distribute illegally. I would try to talk to your lawyer about presenting a possible diversion program with probation in lieu of jail time, especially since its your first offense.
