What is the name of your state (only U.S. law)? OREGON-warrant out of Washigton County in Oregon

6 counts Tampering w drug records
6 counts computer crime
2 counts theft in the second degree
1 count theft in the first degree



She is a desperately addicted person to painkillers. That is what she was messing with drug records for. She hasn't been in any trouble since she was 18, she is 39 now.

Is there any chance she may be sentenced to rehab? She needs it.

any advice would be appreciated.

Prison is great rehab.

I would not agree that prison is great rehab. It is not, by definition a rehabilitation environment. People who will go to any lengths to get drugs are hopelessly addicted and need help to break that addiction. Did she do wrong? Yes. Do I think she deserves to go to prison? No.

Does anyone have anything even remotely helpful to say? Any thoughts about the charges and what the possible POSITIVE outcomes could be?

She needs an attorney, desperately.

However if you actually tell us under which statute/s she's been charged it may help. I'm assuming she also worked in the medical field in some capacity?

yes she did work in the medical field. I'm not sure what statute she's been charged under...I just had the list of charges and was told that the Theft 1 was a class C felony. The others are misdemeanors.

Class C felony in Oregon carries a maximum sentence of 5 years confinement and a maximum fine of $125000.

As I said - she NEEDS an attorney.

She's looking at at least some jail time.

In Oregon the classes and sanctions are as follows. according to Oregon Revised Statutes Chapter 161:


Class A Felony 20 Years Imprisonment $375,000.00
Class B Felony 10 Years Imprisonment $250,000.00
Class C Felony 5 Years Imprisonment $125,000.00
Class A Misdemeanor 1 Year in Jail $6,250.00
Class B Misdemeanor 6 Months in Jail $2,500.00
Class C Misdemeanor 30 Days in Jail $1,250.00


What may aggravate the circumstances is that she was also in a position of trust.

i realize i'm grasping at straws here. We're all sort of in shock. We had no idea. She'll have an attorney on Monday. The what if's until then are killing me.

Since she was a kid?

Has she had drug convictions as a minor?

What she needs to do is get herself into a rehab program NOW.

You're doing the right thing in making sure she has an attorney because without one she has virtually no chance of avoiding at least some jail time.

YES she needs rehab desperately. For a lot of reasons. She isn't a bad person. She is addicted to opiates...which all started after a car accident in which she broke her back. She has fibromyalgia as well. She's just a wreck and constantly in pain and made some really stupid and desperate decisions. I can only hope and pray that a judge will see that she needs rehab. She needs professional help. She'll die in jail.

I know a lot of people say things like this and I know people won't agree with me, but she's family. I want her to get the help she needs.

18 is an adult.

Antigone was actually correct. Jail and rehab can occur concurrently and that might actually her best option.

Just because she may have a chronic pain condition doesn't mean that she shouldn't be penalized; rehab isn't a punishment. Rehab + probation? Possible. We can't honestly say.

She can get help in jail. Sorry, but it's the simple truth.

We're not being mean or judgmental, but the courts see this day in and day out. Someone makes a conscious decision to break the law and then blames it on addiction. Judges also know of millions of (for example) chronic pain patients who do not make the decision to break the law.

It's not an excuse.

Now will it perhaps mitigate the circumstances? Entirely possible.

It's also possible for a decent attorney to negotiate lesser charges and perhaps a probationary sentence. Frankly the charges suggest at least some jail time but you never know.

Honestly, and I know you're really concerned, but you're really not going to know too much more until Monday when she's spoken with counsel.

Definitely retain a lawyer. There are a number of diversion programmes available to people in the medical field who have problems with substance abuse (a lot of medical messageboards have entire forums devoted to these programmes) and a good lawyer might be able to organise participation in one of those as an alternative to a custodial sentence.

There are specialist lawyers who deal with this area of law and they can also help out with licensing issues which arise from this kind of professional misconduct.
