What is the name of your state? California

about 1 month ago i was charged for driving people with a provisional license after 11 pm, and possesion of marijauna in the vehicle (less then one ounce). one of the kids in the car had the weed in his pants and he told the cop it was his, and the cop gave all of us misdermeiner tickets. what should i do about this? Details please!?!?!

Don't worry too much about it. You will most likely be given prop36 and you'll be fine. Just don't make stupid decisions anymore.

You face a $100 fine for the marijuana (not sure, offhand, of the fine for the provisional license violation) and the possible suspension of your license, depending on age and other factors.

This is not a huge deal if you don't do it again.

Oh, and stop smoking dope!

Consult an atty - the PD if you qualify.
That is not a valid charge.

The fact that a CHP (I'm sure that's CHP, is it?) officer gave you a ticket, does not mean the D.A./Prosecutor will actually file the charge. (11352, or 23222?)

This a great example of an innocent person charged incorrectly.

That should NOT hold up to trial.
Consult an attorney.
It is crazy to plead to a charge, when you are innocent.

Does your ticket have a court date on it ?
That is the 'arraignment and plea'. Go to court on that date, and you will find out THEN, whether the DA decided to charge the mj.
If so, ask for the PD or a continuance to seek counsel with an atty, and also ask for the discovery (the police report & the complaint) to take to an atty.

Based on your facts, the mj is not a valid charge.

It sounds like you've been cited into juvenile traffic court.

As for the marijuana, if the police can somehow articulate that the marijuana in your friend's pocket had passed through YOUR hands, or had been in your constructive possession, then you can be charged with it.
