possession of Mariujuna at concert


What is the name of your state (cailforina)?
so am 18 and was really drunk in the parking lot of a concert some how
i end up in jail and because i had i a gram of marijuna i was charge with possession but not with intoxication so this is my first offense
and i know for first time offerders you can keep it off the records
just wondering what i should ask the judge for

What were you booked on? What do you have to appear in court for?

Since you cannot be booked into jail for the marijuana charge (assuming only possession of less than an ounce) I suspect that you were booked for the intoxication pursuant to PC 647(f) and released with no charges pending pursuant to PC 849(b). I suspect you were also cited for H&S 11357(b) for the marijuana.

You may have the option of diversion pursuant to PC 1000 (aka "Prop. 36") if you plead guilty . This will include drug treatment and probation, and at the end you will have the matter adjudicated as "dismissed."

However, marijuana is the only law in California (that I am aware of) that is automatically purged per statute after 2 years. So, the criminal record will not exist in 2 years anyway.

You should consult with local legal counsel before agreeing to any deal or appearing in court.
