Possession of Methadone and Marijuana

My boyfriend was arrested with about 200 mg of methadone and a 20 bag of marijuana, and 1 ambien pill. Methadone was in a bottle with his name on it, but the prescription was more than half a year old (I don't know if it matters). The bottle with ambien was on my name. Also, his friend got arrested along with him and he also had a bag of marijuana on him. Is there any way he can get sale charges and if not what kind of charges can he get?

If what you were asking is whether he could get distribution charges, it depends on the circumstances. The quantities don't seem to be presumptive amounts but why was he carrying around methadone he obviously wasn't consuming in a theraputic fashion?

He's in trouble anyhow. I suspect that with a prescription for methadone he has drug priors. The Ambien is enough to get him in trouble even if the methadone is legit.

He never had possesion charges, but he had some drug paraphenelia charges. At this point nothing is pending. He was on methadone a while ago, however, with three unsuccessful surgeries on his shoulder, methadone was prescribed to his as a pain killer on february 1st of this year and he did start abusing it again. My ambien on the other hand was something he had because I left it in his house and he was bringing it back to me, but no body know that and who's going to believe it anyway.
