Pre-Trial Diversion question


I am in Indiana.

I'm a first time offender and I have two D Felony pending charges.

Am I eligible for Pre-Trial diversion?

1 charge is for Possession of a Controlled Substance (Anabolic Steroid/Testosterone)

1 charge is for Unlawful Possession of a Syringe.

I'm a first offender, full time college student, and I've done everything I can to enlist with the Marines except sign my paper which I cannot do until this is resolved.

I read that a person with a D felony charge is eligible, but I've got 2. Just didn't think it could hurt to ask

My prosecutor wouldn't agree to PTD on these two charges. I'm unsure what the prosecutors in other IN counties would do.

Ah geeze....That's a real shame. Thanks though. What do you think the best course of action would be? I'm willing to do any community service, pay any fine, any drug rehab program (even though this is not addicting) I just am hoping I DONT get probation because it will delay the time i can ship off. Any suggestions? Thanks for your time!

If you are offered a PTD, you will probably have to do at least 1 year probation. I know that's what I was offered with basically the same charges. But I'm not from IN.

If I were you, I'd get an attorney and see if he/she could negotiate a shorter term of probation or a lesser charge. While waiting, go to the closest community Mental Health/Behavioral Health center, and request a Substance Abuse Evaluation, be honest in that evaluation, and follow the recommendations. (Around here, a lot of people go to Centerstone AKA the Center for Behavioral Health.)
