My "friend" has recently had marijuana(10) seeds mailed to her from the UK. She had it mailed to her post office box under the same last name and a different first name. PPl had always told her that it was legal, but someone the other day said it wasnt. They should be here anytime now and she is wondering if she can get in trouble for this. She is also wondering what type of trouble she can get into for this. What are the penalties for something like this if it is illegal?

Marijuana seeds are illegal in the U.S. I have heard that if customs finds them, it just confiscates them and sends you a letter notifying you that it has done so and why. Presumably the person who sent them did not conspicuously label them as such but has used some method of concealment, so the chances are probably small that customs will find them. There is a question whether the post office will deliver mail to a post office box if the addressee is not the boxholder.

In Kansas, I know that containing seeds is no crime. The seeds can be a probable cause for searchs. Also, if she recieves the seeds, she should probably be carefull becuase there is a very good chance that she is being watched. If the seeds begin cultivation( meaning they have spouted, or popped) and she is caught, then she will be charged with cultivation of marijuana which is a felony and charged with 7 years (at most) in prison. So be carefull!!!

Contradiction

If the seeds constitute probable cause, they might not be a crime per say, however they can definatly be used as a "probable cause" stepping stone to a full blown search of person and property.

You may also have to deal with federal charges since it is federal mail that is transporting the illegal substance.
