I thought the issue with Chong is that his "devices" were marketed for marijuana use.

I am not a lawyer, but I believe it is possible to sell pipes and "water tubes" online as long as you market them as "for tabacco use only"

Nope. It was the fact that he was selling them to a state that did not allow the sale of such 'water tubes' or 'for tobacco use only' importing from another state.
