The charge is a class A misdemeanor so the punishment ranges from up to one year in county jail and/or a $4,000 fine or up to two years probation. My experience is that plea offers on these types of cases vary quite a bit from county to county depending on the demographic (college town) and the extent of TABC's presence. In my county they merely require the person to take a TABC class in exchange for a dismissal or maybe a fine on a class C. Other neighboring counties offer probation.
