I live in California. Is it illegal to buy Viagra or other ED medications from someone if I do not have a prescription?

If so, what would the penalty be? Could I be arrested? Would it be considered a misdemeanor (meaning, I assume, a fine) or a felony (meaning, I assume, arrest)? What is the name of your state (only U.S. law)?

Edit: Also, is it common for police to post as salesmen of these medications on sites like Craigslist in order to catch people who may want to purchase them without prescriptions?

It is illegal.

The rest of your post is asking for information on how to circumvent the law. You're not going to get that info here.

Ok, fair enough. Would someone be willing to address the second question? It was: "Would it be considered a misdemeanor (meaning, I assume, a fine) or a felony (meaning, I assume, arrest)?"

Ok, well, then I guess I'm trying to find out what the penalty for this crime would be. What would this crime be considered? Possession of a controlled substance? If any other posters could answer with a response that is less vague, it would be very helpful.

Don't buy the Viagra - then it doesn't matter.

I'm not sure why it even matter what the penalty is.

This is a forum for asking legal questions. I have a legal question: what is the penalty in California for purchasing ED medications without a prescription to do so? I have not been able to find the answer via other methods.

I wasn't aware that my motivations would be scrutinized and summarily judged before an appropriate answer was to be offered.

As I (and many other teachers) have taught students: "There are no bad questions." Apparently that is not the case, here.

It is a fair question.

---

Hundreds of thousands buy, possess and use imported Viagra and other ED drugs.

If you are importing less than a 90 day supply, and have no intent to sell, the odds of any risk of prosecution (apart from your drugs being subject to seizure at customs) are very low.

Sildenafil Citrate (Viagara) is a prescription drug, NOT a controlled substance

I will state, that these drugs have very limited benefit to those without an ED and can give you a NASTY headache.

If you have an ED, ;) ask your doctor and simply get a prescription.

That is much easier and 100% legal. If you have insurance it is also much more cost effective.

That depends on the substance and whether you are talking about an herbal supplement or a drug that requires a prescription.

It is generally a felony to possess or distribute prescription medication without a prescription.

Best bet ... go to the doctor and get a prescription ... it may well be cheaper and safer than buying it on the black market anyway.

FWIW, most of the same benefits can be gained by using certain athletic OTC supplements that expand blood vessels before workouts. They usually include nitric oxide, beta alanine, and arginine and orthinine.
