Will there be Jail Time? Should we get a Lawyer.

What is the name of your state (only U.S. law)? New York

My husband was arrested and charged with Criminal Possession of Marijuana, in violation of section 221.10. I don't know what to do and am scared to death that he will go to jail. This is his first time offense with a CPM, however, he has a charge of UPM (unlawful possession) in December, 2008, and a disorderly conduct charge from July, 2009.

Is it possible? Yes. Does his repeated inability to abide by the law make jail time more likely? Yep. Does that mean its more likely than not he's going to the clink? Probably not. A good lawyer should still be able to get a plea for probation.
