What is the name of your state (only U.S. law)? New York

My husband was arrested and charged with Criminal Possession of Marijuana, in violation of section 221.10. I don't know what to do and am scared to death that he will go to jail. This is his first time offense with a CPM, however, he has a charge of UPM (unlawful possession) in December, 2008, and a disorderly conduct charge from July, 2009. :confused:

Is it possible? Yes. Does his repeated inability to abide by the law make jail time more likely? Yep. Does that mean its more likely than not he's going to the clink? Probably not. A good lawyer should still be able to get a plea for probation.
