2nd dui


What is the name of your state? alaska > sun aug. 24th i just got my dl back > i was helping someone move into an apt. i started to leave two and a half hours latter picked up this soda pop and started to drink. it was mixed. i really did spit it out because no way in this world will i drink and drive again. igot back to my home town 10 mi away stoped at a bank to get gas money out of atm. two city police cars showed up. one officer walked in said someone called and said i was drinking and driving. i blew .099 > i think because of the pop drink. this is true about spitting the pop mixed drink out and not rinsing my mouth. i don't know. i'm done for any way? or do i have a prayer? i swear to god i go to church all the time. and i have not drank in almost three years. my pre trial is the 11th of this month. this will probably be the funniest story you ever heard. but it's all true. i drove my motorcycle and no traffic violations. is there a prayer here or do i just take it.

I believe you! I believe you! You only blew 2 points over the legal limit. Geez, what is this world coming to anyway? They should just have let you go! This is incredible, and unbelievable what the cops are doing to people nowadays! I'm just shaking my head in wonderment.

I wish I could help you. But, since I can't, I guess you're just going to have to "take it".

Just remember, don't bend down to pick up the soap.

Does this board consist mostly of DA's, because 99% of the replies I see for people asking for help get slammed instead of helped. Yes DUI's are a very serious offense, but not everyone that happens to get charged with this deserves to be demeaned or belittled. Most realize what a mistake they have made and are looking to correct this in their life, geez guys I'm not saying that it is acceptable, but I thought this forum was here to help people, not condemn them.....

My response:

By slapping certain writers "upside the head" we ARE helping them. We're helping them see how society in general is going to treat them, and to let them know this behavior is completely unacceptable.

Writers who come here want an "escape route". We don't provide that. We're not paid to provide that. In fact, we're not paid at all.

The time to "realize", however, is BEFORE you get behind the wheel - - not after. "After" is too late. Deaths and severe injuries occur "after". And, if a drunk is lucky enough to stay alive to get to this site, then they deserve to have a little "reality" thrown in their faces.

The laws are on the books. We, the citizens, placed those laws there through our elected officials. That's because the majority of us wanted those laws.

Additionally, when our drunk writers come to this forum, we also remind them that when they signed their applications for their driver's licenses, they promised to obey all of the vehicle laws.

So, why is all of this a surprise? You drink, you drive, you get into trouble, you pay - - dearly.

***Look, if they don't know they are (not have made) making a mistake by getting behind the wheel, then something is wrong with them and probably should not be driving at all, sober or not sober. They are not responsible enough. Just my opinion.***

"happens to get charged"?!?!?!?!

Are you kidding me??? It's no 'accident' when drunk drivers get charged, it's no 'accident' when a drunk driver kills or maims someone---it's all about choice. The drunk driver CHOOSES to drink, and then CHOOSES to get behind the wheel.

So, yes, anyone that "happens to get charged" with DUI deserves the FULL wrath of the rest of us who DON'T drink and drive. When your choices have the potential to affect my life and the lives of my loved ones--well then, damnit, you absolutely deserve my (and everyone's) full condemnation.


(Sorry for the rant everyone. I don't usually post on this board, but this one REALLY got me!)

I'm not trying to excuse drunk driving by any means, what I am saying is that every situation/case is different and individual.

Suppose you are at a Christmas party and one of the snacks there happens to have rum or some other type of alcohol in it, you have one and notice what it is and don't have anymore, thinking nothing of it and not feeling affected you leave 20 mins later to go home. Someone accidently hits you at a stop sign and the cop smells it on your breath, with it being so soon afterwards it may still linger in your mouth (along with acid reflux that it may have caused) and registers say a .09 or even .05 through a breathalyzer. BAM! you get charged with a dui....you don't even drink but maybe once every two years, yet that piece of candy has just caused you to get jail time, massive fines, high insurance, public embarrassement.

I'm NOT condoning it, I'm simply saying that not everyone that gets charged with a dui deserves the death penalty.....

Crafty, why are you apologizing? You have the absolute right to voice your conservative beliefs, and to remind someone of their wrongdoing and their social responsibilities.

Don't apologize. The laws are on the books for all of us, and we should never apologize for that.

IAAL, I wasn't apologizing for my beliefs, the laws, nor my unwavering stance on a matter such as this. I'd never apologize for such a thing because, well, I'm right!

The apology was for my 'butting in' on those who regularly give advice (such as yourself), on a board that I don't normally post on.

A thousand-and-one excuses, huh? The simple (responsible) solution to your above scenario is found in one little question to the hosts:

"Is there alcohol in anything you'll be serving tonight?"
