2nd dui 9 years later


What is the name of your state?california

when i got my first dui , after 7 years it was to be taken off my record, now the new law is 10 years. since i got one 9 years later will it be considered as my second since at the time i received it ,or not since the law was 7 year at the time i received it

Why don't you get into a AA meeting, instead of driving drunk? Who's family do you think you may have killed before you got busted again? You probably don't think of those things since you are rather special, and feel you have a right to drive impared.

Hopefully, you will not be on the public roads of my state untill you can get rehab.

It does NOT get taken off your record. What the old law did was allow for a "look back" period for prior DUIs going back 7 years. The new law looks back 10 years for counting prior DUIs.

So, if you count back for 10 years, THAT is the number of prior DUIs you will be facing for purposes of charging sentencing enhancements.
