2nd DUI.. Im scared. Please helpWhat is the name of your state? CA I received my 2nd DUI in Burlingame, San Mateo County. I am 26 and received my first when i was 20. I served 20 days in jail for failing to pay my fees and complete my DUI classes. I'm certain i was over the limit, maybe even over .15. I failed the field sobriety tests, although the stand on one-leg test is very difficult for me b.c i have crooked/bowl legs. I was the only passenger and there was no accident. I was cooperative and the arresting officer(s) seemed nice. I choose to take a blood test. I don't think i have a case to fight and just need to plea for a lesser jail sentence. I'm reading conflicting statements on many DUI attorney websites regarding the sentence. I've read that a 2nd DUI with probation is a minimum of 10 day, but likely 30+. I've also read that the 2nd conviction is a minimum 90 days. I have a full-time job with a lot of opportunity for growth within the next year. Additionally, I just moved to Northern CAL and am living paycheck to paycheck. I can NOT afford to go to jail for 30+ consecutive days. I will be FIRED. I cant decide whether or not to seek a DUI lawyer, use a public defender, or represent myself. I figure I will be pleading guilty, and wont be contesting the actual conviction. I just need lenience on the jail time. Pros/Cons? What are the eligibility requirements for DUI with probation? Will the DA, judge be understanding that I have a job and cannot afford consecutively served days in jail? Will I be able to do weekend jailing? I really appreciate any advice, insight, or recommendations for DUI lawyers in the San Mateo or San Francisco County area. Thank you, Eugene |

| 3 things your nuts if you represnt yourself... don't just plead guilty. hire a LAWYER ASAP.. BTW 2nd dui why did you not learn your lesson the first time? |

Yup...Uh huh.... Lawey up, ASAP! Try not to go with a public defender. Tell your lawyer all the concerns you listed here. He/She may be able to continue the case until you are more financially prepared. Sometimes, they can delay it for several months. But you will have to face the music some time. So get it over with as fast as you can. This being your second arrest, and blowing possibly more than .15, expect much unpleasantness. Even so, you're lawyer still may be able to finagle some weekend jail for you. I'm not too sure. I'm sure you already know this, but don't EVER drink and drive again, if for no other reason, to keep yourself out of trouble. If you think you are in a bad spot now..... |

| Public defender vs DUI lawyer? Don't I either plead guilty or innocent? If i plead innocent and am found guilty aren't my punishments that much more severe? No excuses. I should have learned my lesson. I have an alcohol problem that has only gotten worse since moving to a new city. Part of the reason I decided to move was to try and start things fresh. I am a recovering drug addict and it seemed like the best thing to do. Unfortunately, I replaced my drug habit with drinking more alcohol. I do realize I have a problem and having been seen a doctor for help. I was prescriped xanyx to help with withdrawal, although I can't say its been very helpful... Its a new year and I'm determined to turn things around for the better. |

Hang in there....Expect some unpleasantness, but if you hang in there, you will pull through without major life upheaval. The system will try to work with you this one last time. Try to get a private attorney. |
