2nd offense Underage Consumption

What is the name of your state? Stevens County: Morris, MN

I recently was given my second underage consumption ticket last week. My first was given back in July. I cooperated with the cops and took the breathalizer and all. I was also carrying some alcohol in a backpack and they said because I cooperated that I wouldn't be charged with possession. They told me to call the courts to find out what my fine was. I did this only to discover I have a court date. I was just wondering what to expect. A fine, there are rumors of jail-time, or could I plea for community service to reduce my fines? I just want to know if I should expect to spend a few days in the slammer, or if I'll just be slapped with a huge fine.

With any luck at all, your license will be suspended.... hopefully until you are mature enough to value the PRIVILEDGE of driving.

Regretably, you will likely only get a HUGE fine... and a probated sentence.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

This wasn't a DUI or DWI, it was an underage consumption ticket. I wasn't driving. The statute was 340A.503

Then why the hell did you post it under "Drunk Driving / DUI / DWI"??

The following are from the Minnesota statutes:
171.173 Suspension; underage drinking offense.
The commissioner of public safety shall suspend the license of any person convicted of or any juvenile adjudicated for an offense under section 340A.503, subdivision 1, paragraph (a), clause (2), if the court has notified the commissioner of a determination made under section 169A.33, subdivision 4. The period of suspension shall be for the applicable period specified in section 169A.33. If the person does not have a license or if the person's license is suspended or revoked at the time of the conviction or adjudication, the commissioner shall, upon the person's application for license issuance or reinstatement, delay the issuance or reinstatement of the person's license for the applicable time period specified in section 169A.33. Upon receipt of the court's order, the commissioner is authorized to take the licensing action without a hearing.

340A.503 Persons under 21; illegal acts.
Subdivision 1. Consumption. (a) It is unlawful for any:
(2) person under the age of 21 years to consume any alcoholic beverages.

As I said... upon conviction of your "underage consumption", be prepared to lose your license.

AND to pay huge insurance costs when you get your OPL back.

You are an alcoholic: alcohol causes you problems. Seek help immediately.
