3rd PA DUI & added charges


What is the name of your state? PA
I'm dating a guy who just got his 3rd DUI in 7 years (.14 BAC) as well as his 3rd driving while suspended. Additionally, other charges include fleeing, disorderly, speeding, & accident involving damage.
I'm not sure about the veracity of the additional charges; he was released on a $3,000 bail. The 2 third-time offenses are true.
I encouraged him to postpone his prelim until he got a good dui atty. He seems to be downplaying the seriousness of this arrest and procrastinating retaining an atty. I have no experience whatsoever with criminal/dui law or persons involved in such. But my research tells me that this guy is in some real trouble and will probably do some jail/prison time. Is this likely? What should I expect? (Besides being dateless in Pgh).

Yes he is in serious trouble... No option for ARD and yes no way if convited to get out of jail. The judges have no option but to hand down mandary min-max for jail. See below

Allegheny county DA.office will not be cutting him a break for a 3rd DUI. He should expect this to go to trail with no plea offer.

I would consider looking for a new BF ASAP. I know someone who got a 3rd DUI in 10 years and is now doing something like 18 months in a State Prision.(Yes he will not be kept in the county jail but state prision)

with his BAC he is facing

1st degree misdemeanor
90 days min 5 year max. imprisonment
$1,500 - $10,000 fine
18 month license suspension
Mandatory 1 year ignition interlock
CRN evaluation
Mandatory full D&A Assessment and compliance with D&A treatment as condition of sentencing.

If convited you can expect the judge to hit him with the higer end of this stuff... with driving while suspened, fleeing etc..


Your BF needs a lawyer yesterday and this is very serious.
BTW.. I live in Pgh if your cute hit me up.

No good deed goes unpunished


I broke up with the guy today and told him that he's in denial about the charges, atty, alcoholism, and prison.

I am now being threatened by him.

I have no proof. But maybe that was the alcohol talking? Should I be more-than-aware or take it seriously?

maybe maybe not... or at times people that have drinking problems friends and family makes excuses for them to justify what they do saying things like that's the booze talking.


Should I be more-than-aware or take it seriously - If I was threatned by anyone I would take it seriously.

Being Threatened By EX-BF w/ 3 DUIs


I appreciated your help PAguy.

UPDATE

The guy extorted $500+ from me on Saturday. Threatened to rip out the construction work he had done for me. Intimidated (read scared) me pretty well. Contacted this site and a cabal of my friends.

Today I went to my township police department to apprise them of the situation. I am not looking to press charges but just want him gone. Once they understood the situation, they took a bunch of vital info, including a copy of my drivers license & phone numbers. Their advice is to call 911 immediately as soon as I see him on my property.

I feel a ton safer now. At least if the worst happens? The police know my address, phone numbers, and my fear in my situation. There probably won't be a "He Said-She Said" slowdown and I'll be certain to get the best service that a good police force could ever provide. (I'm very impressed.)

It feels good having the system work for me. I'm a good person and I do not like the feeling of being afraid.

I hope this helps any other person who finds themselves in a similar situation.
