5th offense is 10 years - question on law and bac


What is the name of your state? Wisconsin

I was pull over for allegedley going 73 in a 55 in Racine Co. The office approced the car and smelled alcohol from the car. Mind you I was driving a friend that was drinking all day.

The office said becasue he smelled alcohol in the car and that I had priors, I had to step out of the car. He asked my If I wanted a breath test after doing the field tests. I askede him what are all of my options. He then said that actually since I have more than 3 offenses, he would have to lace me under arrest and take me to the hospital to have my blood drawn and then put me in the car. ( I have a witness to this).


In truth, I had about 7 or 6 miller lite beers before cutting myself off. I drank from 8pm to 12:00 midnight. I am 6' 280 pounds and male.


Do I have a case? Also, I asked to see the radar since my detector never went off ( I KNOW IT WORKS) and he said I have bigger things to worry a bout now and never showed me. I got a ticket for 73 in a 55 and drunk driving. The blood test results were send to the state and I have not got them back yet. I thought the limmit was .08, but the office told me that in 2001 the law changed for repeaters to .02

From attending AA meetings i can offer this advice:

Admit your a drunk and hope that a recovery/detox home will help you out. One guys story was he was going to jail but was bailed out by some guy that took responsibility over him... That was one guy though. GOod luck.
