Am I up a creek without a paddle (MIP)


What is the name of your state (only U.S. law)?
Arizona

So I have read a few of theses threads and had my questions semi-answered. I am trying to get some advice or suggestions to point me in the right direction. Without it costing me an arm and a leg, and without my parents finding out. So here’s my story:

A couple weeks ago I was in Albuquerque, nm at a few friends apartment were there was drinking. But I choose not to drink, my friends decided since we are going to a club and I m underage I wouldn’t be able to get a drink at the club, that they would buy me a 40 oz. So we went to a liquor store in the worse part of Albuquerque and soon as we turned out of the parking lot and turned the corner two undercover cops pulled us over. Long story short they cited me for having an open container under my seat that my friend put there. But it was a warning. And they also gave me an MIP. I am freaking out here, losing sleep. I m not sure of what to do. Is there anyone that can help me answer these questions?

1. Being a first offense is there anyway I can get it dropped completely off my record?
2. Should I get a lawyer for this or should I just try it alone?

Please please someone help…

You are not going to get this dropped off, unless you can go into court and beat the charge all the way, free, and clear, and to do that, you are going to need a lawyer to help you do it.

You may be a able to cut a deal with the DA, to where you complete all probation requirments, etc, and they might drop the whole thing. If you have priors, they might not want to do that.

Only a good lawyer can advise you on this.

You never, ever, ever, go into criminal court without a lawyer to represent you. Never, think of it this way, if you needed open heart surgury, would you do it yourself, go it alone, or would you get a doctor who knows what he is doing. You would get the Doc.

Court is the same way.

So suck it up, tell your parents, and head to the dance.

Research AZ laws, so you know what you might be in for as well.

This is not that big of a deal, you will probably get a fine, and some kind of probation, if they find you guilty.

Take a lawer with you, if you do not, you will probably get hit harder, then you would have, had you had the proper legal representation.

Mom and Dad are gonna find out eventuallly, they always dol

You should also be worried about what the AZ DMV might do, regarding your drivers license, as they can also hit you on the Administrative side of this charge. You were in a car when you got hit, right?

They do not like minors with booze, and not ones in cars, and what the DMV can or might do to you, is totally separate from what the criminal courts can do to you.

Thank you so much for the advice and suggestions RatPackLar. I will definitely get a lawyer. And I will also look into Arizona's laws as well.

Ha driving in Nm you wouldnt think there's a good part. But I try to give alittle credit where credit is due. But its not much.

hey i might be able to help a little, ill be brief.....

EXACT thing happened to me and i was in court today...

no lawyer, plead guilty, got NO probation, comm service, or anything...also, got it scratched off my record....

all i did was pay the fines, 240 dollars....

this was in michigan though....

(by the way what i did was worse, as i was caught with using a fake id to buy alcohol)

let the judge know you are are sorry, it was a mistake, and you were wrong...they also like to hear if ur in school an or have a job!
