Another DUI statute of limitations question


What is the name of your state? Georgia

I was arrested in May of 2001 for dui. I blew a .082. At the time the laws were .08 - .99 for less safe and .1 - up for per se. Since then (July 2001) the laws have changed to .80 -up for per se. I had a court date for July of that year. My lawyer filed some motions or something and I was set with another court date in Sept. Both of these times I wasnt required to show up. In fact I havent appeared in court at all for anything. That was the last I have heard anything on my case. Now here it is mid Aug of 2002. I am wondering how long do they have to charge me before the statute of limitations runs out? I'd like to hurry up and get my bond money back

Oh and if I do finally go to court...do they take my .082 and say I was a less safe driver under the new laws or does it still apply to the laws that were in efect when I was arrested?

What was the statue of limitations and failure to appear for a DUI in the state of Georgia in 1996?

I dont know what it was in 1996.

you have already been charged. There is no statute of limitations for your situation. Ask your attorney and I'm sure he will tell you that he waived your right to a speedy trial so he can do whatever he is doing to keep you out of jail.
