Question

ARD Revoke+DUI Recharge?


PA

Hello, I really need some help about what my options may be. I can't afford a lawyer. In a nutshell, in 2004 I was arrested for a DUI in which there was no accident and I was being assaulted at the time and had no choice but to drive. Even though it was my 1st and only offense the mag. put me in jail for 12 days until the hearing. At that point I accepted entrence into the DUI prog. mainly just to get out of it the easiest way possible. I served a 3 month License sus. and never paid the 1,500$ fine. At the end of my ARD term, I was told by my probation officer that my ARD was being revoked and it would go back into the system and I would be charged all over with a DUI.He told me to look for somthing in the mail. I heard nothing for 3 YEARS. Last week I got a bill for 1,500$ or go to court. What can I do? Isn't the statue of lim. up on this. Do I still owe for the ARD even though it was revoked?

You can pay the $1500 you owe and pray to God they haven't reinstated the DUI. They don't have to search for you to let you know. The court can just issue a warrant for your arrest.

The STATUTE of Limitations no longer applies. That ran out once you were charged in court (actually, once the ticket was filed with the court).

You assume under a false presumption


You got an a shot under the ARD program, and you screwed it up, and now they, are after you. The boo hoo, assault stuff does not matter, cause you already plead out, and got ARD.

The ARD program gives you a second chance for a mistake made. However, you need to COMPLETE ALL - of the conditions of the ARD program - YOU DID NOT DO THAT.

ARD - you GOT A 2ND CHANCE AND YOU SCREWED IT UP. FROM A PA LAWYER

ARD is a program, designed to divert first time offenders from entering the criminal justice system. When a first time offender is accepted into the ARD program, the Commonwealth requires that certain court-ordered conditions are followed. The ARD program requires a period of supervision.

Now three years later, you come here, crying and looking for help?

You knew this, and during all those three years, you BLEW IT OFF. Three years?

That is how the system will view you.

Your Probation Officer told you, you screwed up, and to expect the mail to come your way.

Hey, you knew it was gonna happen, and you probably did get the mail, and just blew it off, and are now trying to play the lost in the mail dance. They have seen that before.

Hey, if the system told you you were gonna get hit, and watch for the mail, that would tell me that I am gonna get hit, and if I did not get it in the mail, I sure would not think that if the mail did not show up, I would be free and clear.

Tell the truth, not the story.

You OWE and they are gonna pound you, cause they gave you a chance to ARD, and you blew it off.

If you do not do the ARD, they can and might, and will, just re-instate the original charges and pound you.

After all you were given ARD, to avoid those charges sticking.

You screwed it up.

What is worse, you waited THREE YEARS, and only until they caught up with you, to worry about it.

They do not like that.

You need a PA Lawyer and get ready for the dance on this one.

I am no expert here, but I am looking at you, from the outside looking in.

Do not think like a victim, think like the system.

OK there is more to this from what you are saying....

Here is why...

this happened in 2004.... 4 years ago...

The most they can put you on probation is 2 years....

The came back at you if you do not pay the fine.. meaning if you make ZERO effort... they can reinstate the charge.. if you are paying something they keep extening the probation until fine is payed...

now also to get a 90 day suspension....

you had to do one of two things...

refuse.... the FST

or you did ARD at another point to get rid of another DUI charge...

second time you do ARD for DUI it's a 90 day suspension...

I could NOT have been your first offence..... first time DUI's ALWAYS get relaced ROR in PA... you might have spent the night in jail.. so I can also guess you have some other criminal history...

After 12 days in jail they let you into ARD? it never works that fast not to my knowledge... from arrest to the ARD hearing can take from 2- 6 months until your actually get into ARD

I don't mean to rag on you... but you need to give all the FACTS.. plenty of good advice on this board... but good advice does not work on half truths...
