Attempted purchase PAWhat is the name of your state?What is the name of your state? PA I am 19 and was attempting to buy beer with a fake ID. The guy called the cops on me and i was cited. The cop said he was going to let me off easy, and that he would forget about the fake ID as long as I pleaded guilty to attempted purchase. I have not not recieved anything in the mail yet but was wondering exactly what is going to happen to me. I asked the cop what was going to happen and all he mentioned was a fine, but I am very concerned about a drivers license suspention. My question is this: am I definitely going to lose my license, and if that is part of the citation, is there any way i can get out of it or at least get it reduced? I know a lot of people who have recieved underage drinking citations and the like and all of them seem to get out of the suspention. This is also my first offense. |

Section 6308. Purchase, Consumption, Possession or Transportation of Liquor or Malt or Brewed Beverages. (a) Offense defined. - A person commits a summary offense if he, being less than 21 years of age, attempts to purchase, purchases, consumes, possesses or knowingly and intentionally transports any liquor or malt or brewed beverages, as defined in section 6310.6 (relating to definitions). (b) Penalty. - In addition to the penalty imposed pursuant to section 6310.4 (relating to restriction of operating privileges), a person convicted of violating subsection (a) may be sentenced to pay a fine of not more than $500 for the second and each subsequent violation. (c) Preadjudication disposition. - When a person is charged with violating subsection (a), the district justice may admit the offender to the adjudication alternative as authorized in 42 Pa.C.S. section 1520 (relating to adjudication alternative program) or any other preadjudication disposition if the offender has not previously received a preadjudication disposition for violating subsection (a). The use of a preadjudication disposition shall be considered a first or subsequent offense, whichever is applicable, for the purpose of further adjudication under this section or under section 6310.4. If you are convicted of any of the following, your license will be suspended: *Lying about your age to obtain alcohol *Purchasing, attempting to purchase, consuming, possessing, or transporting alcohol *Carrying a false identification card Suspension will be for the following time periods: *First offense - 90 days *Second Offense - 1 year *Third and Subsequent Offenses - 2 years It appears that you may qualify for (c).
