B+P Code 25662(a) What will happen?


Ok, im in orange county, california and i just got a ticket for possesing an alcoholic beverage. BPC 25662(a) i am 20 years old and the bottle was in the trunk sealed and had not been opened. i told the officer about it when he asked me if i had anything illegal in the car. (honestly i thought it was legal to have it in the trunk if it isnt opened but i know that ignorance is not an excuse) I had not been drinking it and i have never had any tickets or arrests for anything. he told me that the he set the court date a few months in advance so i could "raise money for the fine" this scares me becuase it implies that the fine is large. I was wondering how big the fine is and if there are any other consequences for this infraction. some people have said community service or even loosing liscense. any help or advice would be appreciated. i have about 2 months until my date.

Citing you for a beer in your trunk was a little odd ... and might not even rise to the level of possession should you choose to fight it. But! Since you acknowledged it's presence that showed you had dominion and control over it.

You didn't happen to have any alcohol on your breath or give any lip to the officer, did you? That might explain the citation.

Anyway, if this is a first offense, you face a fine of up to $250 and between 24 and 32 hours of community service. However, you can safely assume that fees and admin. reimbursement will make any dollar assessment total up to $450 or so.

No i was totally cooperative and had not had anything to drink for months. the officer was a nice guy and we even laughed a little during our conversation. im not going to fight it i was just wondering what the fine is and if there is any other punishment that goes along with it.

Oh, and the reason he stopped me in the first place was that i swerved a little when i tried to get something out of my back seat while driving. he asked me if i had been drinking and i said no. then he asked if i had anything on me or in my car. the rest you already read.
