CA second dui?


What is the name of your state? California

I recently was arrested for my 2nd DUI. I refused the breath & chemical test. I am still on probation for my first dui.

I have a few questions.

- what are the chances that I won't have to do jail time? or that the time can be converted to house arrest, or something that would allow me to go to work and not lose my job?

- what will happen with the probation from the 1st?

My attorney is pretty confident that I won't have to do time for the dui, and if I do, it'll be allowed to be done on two consecutive weekends. He also said that if a probation violation is filed that he's pretty confident that he can get "house arrest" or "work release".

Does anyone have any advice to offer me?

I've started going to AA on my own, will that help in my case? should I preimptively enroll into a treatment program? Will any of this help my case?

i dont know about helping your case but...aa and getting treatment sound like a GREAT idea

jail?


THanks for the link. I'm definately signing up. the fact that I've gotten two dui's is enough of a wake up for me.

Now I'm worried about losing my job and potentially my career. I just want to stay out of jail (at least during the week) so that I don't miss work and they find out about things.

Any advice re: jail time is greatly appreciated.

There's a mandatory 96 hours jail for 2nd DUI & additional 48 hrs for refusal.
Probation Violations are usu 30 days county jail.

Most jurisdictions charge 10 days county jail for 2nd time DUI.

Was your first time DUI out of the same court as the 2nd ?

I am not an attorney but i work for one in the State of California and we practice dui. I really dont know the facts to the previous dui you had and what agreement you agreed to. There are possibilities that you might do time for violating your probation. Also in this recent dui did you take a blood test or a urine test? Usually if you didnt take any tests the d.a. will not give you a offer. The d.a. will try to take your case to trial because they know that you didnt take the test because you knew you were over blood alcohol and that by now you know how the system works.
