Calif.ON prop36 & just got a DUI NowWhat??


ON prop36 & just got a DUI NowWhat?
Calif. I just got a DUI after being on prop36 for 2mths. with no prior charges on record. DUI Arrest Date:12/02 /07. DUI Court Date:1/02/08. Probation just sent me a notice to report to court on 12/28/07. My BAC:??forgott WHATS GUNNA HAPPEN TO ME??????

No one can say what WILL happen to you. If your DUI is for drugs, then you probably just failed Prop 36 and all those charges might pop back up.

Otherwise, they MIGHT violate your probation ... what WILL happen is still anyone's guess.

Consult local counsel.

Prop 36 is pretty lame.
You can violate about three times before they go thru with the drug conviction.
Unless the Prop 36 Judge has grown a backbone, you will be slapped on the wrist and reinstated.
You can all hold hands and have a group hug.

However, the Prosecutor on the DUI will probably try to violate you ...
and they will, most likely, hammer you on the DUI. (the DUI, even if it was for drugs, stays with the citing court).
If it was for drugs, then they probably will hit you with an 11550 - under the influence, which carries a mandatory 90 days in jail. (If they didn't charge it, the Prosecutor should catch that in court and add the charge).

However, you will, unfortunately, remain in Prop 36 and continue to drug your sorry butt.
Please don't drive when drugging/drinking.
I don't care about you, but there are precious people on the road with you.

And I thought sops were the only ones who saw Prop. 36 as a free pass!

Sadly, the next week holds two funerals for slain officers murdered last week by young pukes with guns ... and the memory of my friend murdered on duty last year at this time by yet another teen with a gun ...

Let us all remember to hold our families close, for this life is fleeting.
