Question

Can I move while in ARD?


What is the name of your state (only U.S. law)? PA

I received a DUI in November and blew a .125. I will know on April 3rd if I will be accepted into the ARD program. Now, I am planning on moving to AZ for school in June. My question is: will I be able to move to AZ in june and complete the ARD program there? Or will I be stuck in PA?

You need permission of the probation department in PA. Chances are if you've been behaving and ESPECIALLY if you are current on your fees, they'll allow it. Normally on probations they will transfer it to the state you are moving to (which has the option not to accept it but it's usually routine). However, that can frequently take six months and since ARD probations are usually pretty short in comparison, and ARD probationers usually aren't directly supervised, they may settle for "call me if you get arrested or a ticket for anything" but it depends again on your probation officer.

this pretty dead on. In most counties... ARD is none reporting probation... and you call if anything happends.... like you get arrested again.

how long is your suspension? 30 or 60 days?
