Can they do that? What is the name of your state? GEORGIA. My son was charged with disorderly conduct, since he would not get in his car and leave,BECAUSE HE WAE DRUNK,they took him to jail. The ciatation is for disorderly conduct. We went on his court date and the DA had added DUI to the charges. On the citation the police officer wrote in very large letters " was not driving".The DA says he has a witness that he was driving. WHAT I have never heard of that.Could someone PLEASE tell me if they can do that? |

| They already did - you need to (or rather, HE needs to) consult a local attorney, not an internet forum. |

| I can understand your frustration, but I agree with Zigner, they already DID. You need to help your son find a lawyer that specializes in DUI LAW. Emphasis on DUI LAW. As in, knows how to defend DUI cases and not just tries to for the sake of a dollar. Google the website for National College for DUI Defense. They have a reference of lawyers by state. |
