cdl drivers


What is the name of your state?Pa
Please define if .04 implies to operating your own non-commercial vehicle also. Example I have cdl to driver a over the road truck and I am home for the weekend and decide to go to the bar and have a couple of drinks. Then get pulled over for suspicion of D.U.I. am I under the .04 or .08 rule

.04 regardless of what vehicle you are driving. My husband has a CDL and as a result never drinks if he is away from home because the limit is so low.

Actually, the limit of 0.04% applies only to the operation of a commercial vehicle, not the a CDL. If a CDL holder is driving a non-CMV, then they standard of 0.08% applies.

Question 4: Is a driver disqualified under §383.51 if convicted of driving under the influence of alcohol while operating a personal vehicle?

Guidance: The convictions triggering mandatory disqualification under §383.51 all pertain to offenses that occur while the person is driving a CMV. However, a driver could be disqualified under §383.51 (b )( 2)( i ) if the State has stricter standards which apply to offenses committed in a personal vehicle. (The same principle applies to all other disqualifying offenses listed in §383.51 .)



You would need to look up Pa. law, to see what standard they hold thier drivers at. Many states are now holding a CDL driver to the higher standard even in thier regular vehicle.

Frankly as a CDL holder, you should be EXTREMELY careful about safeguarding your license and livelyhood. Unless you have a designated driver you should never drink and drive.
