What is the name of your state (only U.S. law)? CA

If your under 21 and failed a breathalizer test, but was given a citation for another violation, can they decide charge you with the underage drinking in court?
On the citation they wrote down the other violation and the BAC, but the officer only marked it as other violation instead of the the underage drinking.

*IN* court, no ... they can, however, amend the charges prior to court.

Once inside the court room you will be facing ONLY the charges for which you have been charged.
