Charged with DWI in NC and found not guilty...Can I remove this charge from record?


What is the name of your state? North Carolina

Thank you for taking a look at my question and any advice or comments would be greatly appreciated.

I was charged with Driving While Impaired after being stopped at a checkpoint in NC. I was later found not guilty. This was in the summer of 03'.


My question is in my case I was found not guilty. Is there any way to remove this charge from by records since I was found not guilty. The reason I ask is I had to have a background investigation completed and it did show the charge, but it also showed that I was found not guilty. I would definitely prefer to have the erased from my records to avoid any future problems it may cause.

Sorry it is so long, but I just want to take the corrective measures to resolve this issue and move on. Thanks again.

-Who did you have the background with?

Generally in California, potential employers only have access to convictions on a criminal history check. That is unless the employer is law enforcement related, then they have access to all of your records.

You need to consult with and hire an attorney to have the arrest expunged from your record.

Yes. I did have a criminal background check completed for my future employer and it did flag a record for my criminal history report, but it also stated that I was found not guilty.

I just wanted to verify if it was possible to have a record namely a charge of DWI expunged or removed. Looking online it seems that NC does offer an individual one time that they can have a record expunged or removed.

I'm curious. How did it come about that you were found not guilty? Were you found not guilty after a trial - or were you never convicted? If you wouldn't mind, could you give some details about your case? Thank you.

Why does the poster need to hire an attorney (so someone can get money)? The charge was dropped. PERIOD. It should be off their record ASAP if she was not charged. NO ATTORNEY NEEDED! They can simply call the arresting figure and have the charge removed in a timely manner - otherwise they can sue if it continues to show up on a background report.

Sorry, you can't fund your inground pool this summer.

Oh I didn't know just a polite request to the "arresting figure" via the phone and it would be removed from his record. Do you think this "arresting figure" has access and the ability to change people's records with the touch of a couple of buttons?

Think for a minute. Don't you think it would have been taken off the record already - its been two years?

Now wouldn't that require hiring a lawyer? Maybe you can help the OP for free. You seem to know all about getting arrests removed from someone's record.

Thanks for the replies. Yes. I had my day in court and looking at the facts the judge found me not guilty.

It seems this would be something that I would have to consult an attorney?

I wasn't sure if there was a way that an individual could file the necessary paperwork on their behalf to have this removed.

Also is there a certain time period that charges phase off of your record or is it permanent? Does the fact that I was found not guilty help?
