Charged with OUI in ME .. .05%


I was pulled over in maine with my friend on a highway in maine. I was packing a lip of chewing tobacco as the officer approached my car and talked to us. My friend in the passenger seat had just downed a few funneled beers and a full mixed drink of gin and coke, and was pointing his head (and breath) in the direction of the officer whenever he talked to him. The officer asked me to get out of the car and performed a sobriety test. I did pretty good at it .. but he still took me to get brethalized.

I have asthma and the first 5 results for the brethalizer came up insufficient result, till another cop came and made me blow harder and we got 2 results. The result turned out to be .05 % .. which is below .08 but since I'm 19 I will be charged with an O.U.I.

I was also arrested for driving on a suspended license ... although I was unaware that it was suspended. It had been suspended for an event that happened in Florida, and I had got a document from Florida and had my mom drive it to the N.H. (where I live) DMV. I also asked my lawyer about it and she said she would take care of it and my licsense would be back immediately.

I got out on a condition that I was sober so I got out of jail right away with a $40 bail. Since I was arrested at 2:30 the lady cop in the booking station told me I could leave .. I ended up getting a friend to bail me out around 10 am.

I really don't have the money for a DUI lawyer, but I want to get one and I don't want to lose my license .. although I understand that will probably happen. I might get one for free through my uncle.

My questions -

.05 is an amount that could be caused by something like drinking Nyquil. If I said I drank a lot of Nyquil do you think that might be a plausible defense? Its 10% alchohol and I have a cold.

How should I start preparing for this? The officers in the jail I was at talked to me for quite a while and were pretty much on my side .. do you think they would be a good witness in court to help show I'm a good person?

Is there anything I should know or research?
