citation fine vs court fine

My 19 y/o son received a MIP walking home from a college party. The fine on the citation was $410. The adminstrative attorney at the university who interviews students with MIP citations advised him to go to court, plead guilty and pay the fine. The judge gave him the choice of a $1000 fine (vs the $410 on the citation,) OR a MADD evening, 3 AA meetings and 2 Saturdays of community service. He opted for the latter but is having second thoughts. We are wondering why the judge fined him $1000, should he chose to pay instead of the other conditions, instead of the $410. Is it too late to just pay off the citation? Will the MIP fall off his record in three years no matter how he handles it? Thanks for any information.

A: He should ask the judge who sentenced him.


Q: Will the MIP fall off his record in three years no matter how he handles it?

A: While he is asking the judge who sentenced him about the fine, have him ask this question also.

He (not you) needs to call the court of the clerk where he was sentenced.

completed requirements, now what?

My son completed everything the judge asked of him and paid his fine. So case closed. Does he now have to report this MIPC on rental applications, job applications, etc.? How does one go about having this record sealed or expunged? We are in Nevada. Thanks!

A: Yes, if someone asks him about convictions.

A: See below. That may give you some info on how to find out about this stuff in your state.

Expungement/pardon

There are several thousand questions on this forum similar to yours. Thus, I have prepared a standard answer.

Standard answer: Expungement is generally granted for illegal arrests or unlawful convictions. Generally, pardons mean you are forgiven for the crime but it remains on your record.

Check with the governor or attorney general of your state to see how you can go about either of these procedures. Check with the Attorney General or the President for federal expungement or pardon.

You must remember that there may be private background check companies that have past offenses on their databases; those reports will never be expunged.
